Heard Mr. P.C. Pandey, learned counsel for the petitioners and Mr. Vivek Verma, learned counsel for respondent nos. 3 and 4.
By this writ petition, the petitioners seek a direction to the Nagar Nigam to renew the license of E-Rickshaw for the year 2018-19. Mr. Verma, learned counsel for the Nagar Nigam submits that the license relied upon by the petitioners (Annexure-1), was issued by the Nagar Nigam though inadvertence. He submits that after the notification dated 8 October, 2014 issued by the Ministry of Road Transport and Highways bearing no. G.S.R.709(E), it is the concerned authority under the Motor Vehicles Act, 1988, alone can issue such license. He placed reliance upon Rule 16 of the Central Motor Vehicles Rules, 1989 (for short Rules, 1989), as amended by notification dated 8 October, 2014. On being confronted with this, counsel for the petitioners seeks permission to withdraw the writ petition with liberty to the petitioners to approach the concerned authorities under the provisions of the Rules, 1989 for issuance of the license for E-Rickshaw.
The petition is disposed of as withdrawn with liberty as prayed.
