(Per : HONOURABLE MR.JUSTICE RAVI R.TRIPATHI) Learned APP Mr.L.R. Pujari places on record communication dated 18th July 2012 received from Mr.H.J. Bhatt, Police Sub Inspector, Limdi Police Station.
Rule was issued on 29th June 2012 returnable on 9th July 2012. On perusal of the contents of the application and the Jail remarks and the Police opinion dated 18th July 2012, the application requires consideration.
2. The applicant- appellant- original accused has been convicted for the offences punishable under sections 302, 201 and 397 of the Indian Penal Code to undergo imprisonment for life as awarded vide judgement dated 13th April 2009 by the learned Additional Sessions Judge, Fast Track Court, Surendranagar, Camp Limdi in Sessions Case No.87 of 2007.
3. The learned APP has invited attention of the Court to the Jail remarks. The convict has undergone 3 years, 6 months and 22 days in Jail. The convict had enjoyed temporary bail once and has reported in time.
4. For the contents of the application, the same is allowed. The convict is ordered to be released on temporary bail for a period of 30 (thirty) days from the date of his release on his executing a personal bond of Rs.5000/- (Rupees five thousand only) to the satisfaction of the Jail authorities.
5. The convict shall surrender himself to the Jail authorities on expiry of the above temporary bail period. Rule is made absolute.
