Heard Shri Shive Datta Yadav, learned counsel for the petitioners; Shri Bipin Bihari Pandey, learned Additional Chief Standing Counsel for the State respondents and Shri Amresh Singh, Advocate appearing for the sixth respondent.
Notice need not be issued to the private respondent in view of the order proposed to be passed.
Petitioner before this Court is assailing the validity of order dated 30.08.2001 passed by Additional Commissioner-III, Bareilly Division, Bareilly.
At the very outset, learned Standing Counsel as well as Shri Amresh Singh, Advocate raised a preliminary objection that the present writ petition has been filed with the delay and laches and the same is liable to be dismissed on this ground alone.
On such an objection, this Court has proceeded to consider the report submitted by the Stamp Reporter wherein it has been mentioned that the present writ petition has been filed with the delay of 16 years 178 days. This Court has also perused the record in question and the same does not contain any plausible reason for the delay and laches, in view of this, the writ petition cannot be entertained by this Court and the same is dismissed on the ground of delay and laches. However dismissal of the present writ petition would not come in the way of petitioner to agitate his claim before the appropriate forum.
