Heard learned counsel for the petitioner and learned Standing Counsel for the respondents No. 1 and 2.
The petitioner claims that he is in occupation of a shop situate in temple for the last many years. He was granted a Patta(lease) of the same by one Jamuna Das, who was the Manager of the temple. Now the respondents No.3 to 8, who are private persons, are adamant to demolish the shop and to evict the petitioner therefrom.
If that be so the writ petition for the purpose is not the appropriate remedy.
The petitioner for the satisfaction of the above grievance may file a civil suit as may be advised to him.
The Writ Petition is misconceived and is dismissed.
