Heard Sri Saksham Srivastava, learned counsel for the petitioner, learned A.G.A and perused the impugned FIR as well as material brought on record.
This petition has been filed for seeking a writ of mandamus commanding the SSP, Aligarh to consider and dispose of the application dated 6.4.2019.
The pith and substance of the application is that the petitioner, an accused in a case instituted by private respondent alleges that the informant is habitual in filing frivolous cases under SC/ST Act including the petitioner only with a view to obtain compensation.
Learned counsel for the petitioner could not demonstrate that there was any statutory obligation cast upon us to direct the authority concerned to decide such an application.
The petition is dismissed as not maintainable.
However, this order shall not be an impediment for the petitioner to take recourse options as are permissible under law.
