Heard Sri Dinesh Kumar Yadav, learned counsel for the petitioners and Sri Neeraj Kant Verma, learned Additional Government Advocate-I on behalf of the State.
This petition has been filed by the petitioners challenging the FIR dated 103.04.2019 giving rise to Case Crime No. 188 of 2019, under Sections 452, 308, 504, 506, 354Ka I.P.C. and 66-A Information Technology Act, Police Station Medical College, District Meerut.
The submission of the learned counsel for the petitioners is that it is out of grudge amongst the family, where the prosecutrix is a sister-in-law of the petitioners, that the present first information report has been lodged.
Sri Neeraj Kant Verma, learned Additional Government Advocate has opposed the motion to admit this petition to hearing and taken the Court through the statement of the victim recorded under Section 164 Cr.P.C.
From a perusal of the statement of the victim, we find that the allegation in the statement under Section 164 Cr.P.C. run to the effect that the petitioner ravished the prosecutrix, shaved her head, where the sister-in-law (Nanand), who is also an accused, confined her by putting a cut throat to her neck, smeared black paint on her head, garlanded her with shoes and a video clip of the same was taken and uploaded to the Youtube.
We are convinced that is is not a case where the impugned first information report can be quashed. We, accordingly, decline to quash the impugned first information report.
This writ petition stands dismissed.
