Heard learned counsel for the appellant and Sri Radhey Shyam, learned counsel for the Insurance Company.
This Court on 11.09.2018 on the offer given by the appellant passed the following order, which is quoted below:-
"During the course of argument the counsel for the appellant submitted that if the claimants are paid Rs.-3,00,000/- lump-sum in addition to the awarded amount, the claimants shall be satisfied. The offer on the part of the appellant appears to be reasonable, and therefore, in the facts of the present appeal counsel for the respondents/Insurance Company is granted two days time to seek instructions in this regard.
Put up on Friday, i.e., 14.09.2018 in the additional list."
Sri Radhey Shyam, counsel for the respondents states that the company is ready and willing to compromise the matter and undertakes to pay Rs.3,00,000/- to the claimant in satisfaction to the claim made by the appellant.
In view of the above, the award of the Tribunal is modified to the extent that the appellant are entitled to receive Rs.3,00,000/- in addition to amount awarded under the award. The Insurance Company shall pay the amount of Rs.3,00,000/- within a period of three months.
In case, the aforesaid amount is not paid within the aforesaid period, the Insurance Company shall be liable to pay interest on the aforesaid amount at the rate of 12% from the date of institution of claim petition.
With the aforesaid observation the appeal is disposed off on the basis of compromise before the parties.
