Heard learned counsel for the petitioner, Sri Arun Kumar, learned counsel for the respondent no. 5 and learned Standing Counsel appearing for the respondent no. 6.
By means of this writ petition, the petitioner is claiming compensation for an acquisition alleged to have been made in the year 1985.
At this belated stage, the petitioner has come to this Court. The petitioner has also not filed the notification under Section 4 for the said acquisition. However, from the pleadings, it appears that the petitioner admits that certain compensation was paid to the respondent no. 4.
Be that as it may, the petitioner has woken up after more than 30 years to claim compensation which admittedly appears to have been paid to somebody. As such, in writ proceedings, disputed question of fact cannot be gone into that too with such laches.
The writ petition is accordingly dismissed.
