JUDGMENT / ORDER

Heard learned counsel for the applicant, Shri Mohaammad Aslam Ansari, learned counsel for the complainant and learned Additional Government Advocate.
It is argued by the learned counsel for the applicant that the applicant is the mother-in-law and as many as 14 persons were implicated in this case. The death occurred in Delhi and the deadbody was cremated in Saharanpur and at the highest the case would not exceed section 201 IPC, which is bailable. The co- accused Amit and Rajiv, who are Devars and father-in-law Chandrapal have been granted bail by the trial court. Although the incident is said to have taken place on 14.8.2009, the FIR was lodged on 17.8.2009 and the case was registered on 19.8.2009.
Learned counsel for the complainant and learned AGA, however, argued that the last incident of 11.8.2009 took place in Delhi, in which the applicant mother-in-law and husband and Virendra, who are shown as present, are said to have harassed the deceased, who had made a phone call to her brother, but it is argued by the learned counsel for the applicant that in this last incident, there was no demand of dowry.
It is, further, argued by the learned AGA that there has been repeated demands of dowry on various occasions and on these grounds the applicant ought not to be granted bail.
Having considered the submissions of the parties and without expressing any opinion on the merits of the case, let the applicant Munni alias Munesh, involved in case crime No. 297 of 2009, under sections 304-B/498-A/201 IPC and 3/4 of Dowry Prohibition Act, police station Nakud, district Saharanpur, be released on bail on her furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
