Heard learned counsel for the petitioner, learned Standing Counsel for the respondent no.1 and Sri Rajesh Kumar Yadav, learned counsel appearing for the respondent nos.2 and 3.
The petitioner is seeking mandamus commanding respondents to pay arrears of salary by providing benefit of A.C.P. Scheme under the Government Order Dated 26.7.2010 and 7.2.2014 as adopted by the respondent-Nagar Nigam.
The petitioner is claiming arrears of salary of the Assured Career Progression (ACP) for the post of 'Safai Karmchari' in the Nagar Nigam. The petitioner has superannuated on 31.10.2015.
Submission is that the Government Order dated 7.2.2014 has been issued in continuation of the earlier Government Order dated 26.7.2010 wherein the benefit of ACP Scheme has been extended to the employees of the Nagar Nigam.
The petitioner has approached respondent no.2 for redressal of his grievances.
Learned counsel for respondent Nagar Nigam submits that respondent no.2 is the competent authority to look into the matter.
In view thereof, this writ petition is being disposed of with a direction to respondent no. 2 to consider the claim of the petitioner, in accordance with law, and pass a reasoned speaking order expeditiously, preferably within a period of three months from the date a certified copy of this order is produced before it. All consequential action shall be undertaken expeditiously.
