Heard Sri Rohit Pandey, learned counsel for the petitioners and Sri Anand Kumar Tiwari, Advocate holding brief of Sri Dhananjay Awasthi, learned counsel for respondent nos.1 and 2.
The petitioner is aggrieved by the order dated 30.04.2019 passed by the opposite party no.1, All India Council for Technical Education. Learned counsel appears for the opposite party nos.1 and 2, prays for time for filing a short counter affidavit.
This Court finds from perusal of order impugned that it says that the letter of intent that was issued earlier to the institution is valid for three academic years from the current Session, if the petitioner approaches again within validity period after Establishment of infrastructure facilities, and the requirements notified in the Advertisement published on 31.12.2018 are completed, The AICTE may reconsider grant of Letter of Approval. It is apparent that the petitioner's case open for reconsideration for subsequent years by the AICTE.
This Court feels that no useful purpose would be served in keeping the petition pending the AICTE has already given liberty to the petitioner to complete all the infrastructure facilities which were found lacking in the institution on inspection and then submit its documents for approval which shall be considered, in accordance with the new requirements by the AICTE within two months from the date of its completion.
If such an application is made by the petitioner within two weeks the same shall be considered within a period of six weeks thereafter.
With the aforesaid observation, this writ petition is finally
disposed off.
