Heard Shri Zainul Abdin, learned counsel for petitioner and learned A.G.A. for State of Uttar Pradesh.
This writ petition has been filed for quashing the F.I.R. dated 04.12.2018 registered as Case Crime No. 669 of 2018, under Section 3/5/8 of Cow Slaughter Act, Police Station- Mau Aima, District- Allahabad.
In the F.I.R. in substance the allegation has been made that on 03.12.2018, when the raid was made at the house of the petitioner then skin of one cow was recovered from the room by the side of the road and nobody could be arrested on the spot.
Counsel for the petitioner submits that petitioner was not arrested on the spot. Only on the information of police informer, petitioner has been named in the present F.I.R.
In view of the fact of present case writ petition is disposed of with the direction that petitioner shall not be arrested in Case Crime No. 669 of 2018, under Section 3/5/8 of Cow Slaughter Act, Police Station- Mau Aima, District- Allahabad till the submission of report by Investigating Officer under Section 173(2) Cr.P.C.
