Heard learned counsel for the applicant, learned AGA for the State and perused the record.
Learned counsel for the applicant submitted that applicant was challaned under the Gangster Act on the basis of two cases shown in the Gang Chart. However, in those cases he is on bail. He further submitted that applicant will not misuse the liberty of bail, will cooperate with the trial and he will not indulge in any such activities if he is released on bail. In the present case, the applicant is in jail since 24.9.2009.
In view of the above, without expressing any opinion on merit, let the applicant Munna @ Saddam be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of court concerned in Case Crime No.324 of 2009, under Section 3(1) U.P. Gangster Act 7/1986, P.S. Collectorganj, District Kanpur Nagar.
