Heard learned counsel for the petitioners, learned A.G.A. for the State through video conferencing and perused the record.
The present writ petition has been filed by the petitioners with a prayer to issue a writ of mandamus commanding / directing the respondent nos. 2 and 3 not to harass the petitioners.
Learned counsel for the petitioner submitted that one Kapil Deo Yadav has lodged the first information report under section 363 and 366 I.P.C. police station Gopiganj District Bhadohi on 30.4.2021 against Ajay Kumar Yadav, the son of petitioner no.
1. The petitioner nos. 1 and 2 are father and mother of Ajay Kumar Yadav and petitioner nos. 3 and 4 are brothers of Ajay Kumar Yadav. They have no concern with the alleged incident. The police of police station concerned is harassing them by calling them at police station.
Learned A.G.A. opposed the prayer and argued that the son of petitioner nos.1 and 2 namely Ajay Kumar Yadav is wanted in case crime no. 113 of 2021 under section 363 and 366 I.P.C. police station Gopiganj Distrit Bhadohi. The victim has not been recovered till date and the statements of victim under sections 161 and 164 Cr.P.C. have not been recorded. As per first information report, the victim is minor aged about 14 years.
Considering the facts and circumstances of the case, we do not find any ground to issue any direction in the matter.
The writ petition lacks merit and is liable to be dismissed. Accordingly, the writ petition is dismissed.
