The appeal is taken up for hearing. Learned A.G.A. is present.
As per office report dated 15.7.2021/23.8.2021, it is reported that as per report of learned Chief Judicial Magistrate, Budaun, appellant no.1- Munna Lal and appellant no.2- Aram Singh have died.
I have perused the report of learned Chief Judicial Magistrate, Budaun and the report of Serving Officer and certificate issued by Kamlesh Kumari, Village Pradhan that appellant no.2- Aram Singh has died on 28.5.2012 as well as photocopy of death certificate issued on 18.7.2012 and the statements of witnesses Ram Singh, Horam Singh, Amit Kumar, Kamlesh Kumari Village Pradhan, Serving Officer S.I. Mahavir Singh.
In above circumstances, it is perused that appellant no.1- Munna Lal and appellant no.2- Aram Singh have died. Accordingly, the instant appeal is dismissed as abated.
