Petitioner is before this Court assailing the order impugned dated 27.8.2018 passed by Sub Divisional Magistrate, Patiali, District Kasganj in Case No. 03584 of 2018 (Lekhpal Vs. Moti), under Section 38(2) of U.P.Revenue Code 2006.
At the very outset, Sri Apurva Hajela, learned Standing Counsel raised an objection that against the order impugned, the petitioner has got efficacious alternative remedy by preferring an appeal under Section 38(3) of the Code 2006 before the Collector concerned.
Once the alternative remedy is available to the petitioner as aforesaid, there is no reason or occasion to by pass the said statutory forum. The writ petition is accordingly dismissed on the ground of alternative remedy.
