This petition has been filed with a prayer to set aside the order dated 25.2.2019 passed by the Trial Court/Sessions Judge, Court No.XII District Agra and direct the court below below to provide one more opportunity to recall the P.W. 3 Pappu and to cross examine of Pappu Singh on the issues regarding the application dated 25.11.2011 and affidavit dated 24.11.2011.
Submission is that request of the applicant for cross examination of P.W. 3 Pappu has been illegally turned down by the court below by the impugned order dated 25.2.2019.
No useful purpose would be served by issuing notice to O.P. No. 2, which shall further delay the conclusion of the trial.
Therefore, it is directed that in case the applicant deposits Rs. 5,000/- before the court concerned and files an application within three weeks from today for summoning P.W. 3, for the purpose of cross examination, shall be allowed one and last opportunity for the same. The amount of Rs. 5,000/- shall be paid to O.P. No. 2 Smt. Rekha Kushwaha.
With the above direction this application is finally disposed of.
