As per report of C.J.M., Fatehpur, sole revisionist-Munna Lal Gupta died on 9.4.2009. Sole revisionist is an accused in case no.1060/93 State vs. Munnu Lal, u/s 467, 468, 420, 409 IPC, P.S. Kotwali, district Fatehpur, so this revision has become infructuous.
On perusing the record, it is transpired that the lower court findings are based on proper appreciation of evidence. There is no infirmity or illegality in the order passed by the Court below. So, I do not find any reason to interfere in the impugned order. Consequently, revision is devoid of merit and is liable to be dismissed.
Revision is dismissed.
Stay order, if any, is vacated.
A copy of this order be transmitted to the learned lower court for compliance within one month.
