Heard learned counsel for the petitioner, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 04.07.2018 registered as case crime no.291 of 2018 u/ss. 342, 307, 120B IPC, PS. Ramkola, District Kushinagar.
Learned counsel for the petitioner submits that it is a case of no injury.
Learned A.G.A. opposed the prayer for quashing and submits that injuries have been sustained by the injured.
Considering the submissions advanced by learned counsel for the parties and the nature of allegations, it is directed that the petitioner shall not be arrested in the above mentioned case till submission of police report under section 173(2) Cr.P.C. but he shall co-operate with the investigation of the case.
It is made clear if there appears to be any medical examination report of the injured, the order granting interim relief to the petitioner shall stand discharged.
With the above direction this petition is finally disposed of.
