The present writ petition has been filed praying for a writ of mandamus commanding the respondent-revenue authorities to remove the alleged encroachment over Plot No. 614.
The revenue records annexed with the writ petition show that Plot No. 614 was recorded as Abadi and a temple of 'Sati Mata' exists on the plot.
It is not the case of the petitioner that the plot ever vested in the Gaon Sabha.
In view of the aforesaid, it is apparent that the dispute is not within in the realm of public law remedy but the dispute is regarding a private law right.
The writ petition is not maintainable and is dismissed.
