Heard learned counsel for the petitioners and learned A.G.A. for the State.
This petition challenges the F.I.R. dated 15.4.2021 registered against the petitioners, who are real brothers as learned counsel repeatedly submitted five times, as Case Crime No. 166 of 21 under Section 3(1) Uttar Pradesh Gangster and Anti-social Activities (Prevention) Act, 1986 at Police Station Dhampur, District Bijnor.
The factual data goes to show that the petitioners have indulged in slaughtering cows. Petition raises disputed questions of fact which emerge even from the F.I.R., which were earlier lodged against the petitioners. Just because they are real brothers, it cannot be said that allegations are false, fabricated and quashment should be allowed. We are fully satisfied that this is not a case where we should interfere under Article 226 of the Constitution of India for quahsing the F.I.R. Further, prima facie, it is not pleaded to the satisfaction of the Court that the F.I.R. has been lodged just because one of the petitioners is a social worker and there is political rivalary against him.
Dismissed.
