This writ petition has been filed on behalf of petitioner Munmum Raja @ Halke Rajju seeking the quashing of impugned order dated 21.03.2018 passed by the Commissioner, Jhansi Division, Jhansi in Case No.00459/2018 (Computerized Case No. C201806000000459), Munmun Raja @ Halke Rajju vs. State of U.P., u/s 6 of the U.P. Control of Goondas Act, 1970 and impugned order dated 23.02.2018 passed by the District Magistrate, Lalitpur in Case No.140/2017 (D201706450718) State vs. Munmun Raja @ Halke Rajju, u/s 3 of U.P. Control of Goondas Act, 1970, Village-Guryana, Thana-Narahat, District- Lalitpur.
Heard learned counsel for the petitioner and learned A.G.A. and also perused the record.
Submission of counsel for the petitioner is that the appeal filed in the court of Commissioner has been admitted but the interim stay has been refused which is likely to render the appeal infructuous.
In the facts and circumstances of the case, this petition stands disposed off with the direction to the concerned lower appellate court to make an endeavour to decide the appeal expeditiously, if possible within next three months from now.
In aforesaid period of three months or till the decision of the appeal, whichever is earlier, the operation of the impugned order dated 23.02.2018 passed by the District Magistrate, Lalitpur in Case No.140/2017 (D201706450718) State vs. Munmun Raja @ Halke Rajju, u/s 3 of U.P. Control of Goondas Act, 1970, Village-Guryana, Thana-Narahat, District-Lalitpur shall remain in abeyance.
