Muniyandi vs State Of Kerala

High Court Of Kerala|04 December, 2014

JUDGMENT / ORDER

Petitioners approached this Court alleging random selection of persons who are registered in Ext.P5 for the benefit of financial assistance granted to SC people in Devikulam Block for purchasing the land. According to the petitioners, petitioners names are also listed in Ext.P5. Therefore, it is submitted that instead of choosing persons from Ext.P5 in random, the names shall be selected based on a draw or a lot.
2. I am of the view, there should be some criteria in choosing persons among Ext.P5 if the benefits are given to the less number of persons in Ext.P5. It is admitted that all the persons in Ext.P5 are eligible. If no other mechanism is provided to choose among persons in Ext.P5, as rightly pointed out selection shall be based on draw after convening all persons, is a fair method. Therefore, petitioners grievance in Ext.P6 shall be considered in the light of the above before choosing persons among Ext.P5 list by the third respondent.
The Writ Petition is disposed of.
