Respondent Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed High Court may be pleased to issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the respondent in marking and threatening the demolish a portion of the petitioner's building property constructed in 99 ½ sq. yards of site bearing door No. 3-14-3/1 in Town Survey number 2 situated within the Municipal limits of respondent, as illegal, irregular, irrational being violative of provisions of Andhra Pradesh Municipalities Act, 1965 and offends Articles 14, 21 and 300-A of Constitution of India and consequently direct the respondent not to demolish any portion the petitioner's said building property;
The petition coming on for hearing, upon perusing the Petition and the affidavit filed herein and upon hearing the arguments of SRI NIMMAGADDA SATYANARAYANA Advocate for the Petitioner and of Sri S. Nageswara Reddy S.C. for respondent, the Court made the following:
ORDER: “ Post on 27-04-2011 along with W.P.No. 10595 of 2011.
Till then, there shall be stay of demolition pursuant to the impugned notice.”
