The petitioner claims that he was entitled to be appointed under the quota reserved for ex-servicemen. There is a specific stipulation under the quota reserved for ex-servicemen that the disabled ex-servicemen shall be given priority in such appointment. The petitioner has made a representation in this regard. The District Magistrate Farrukhabad had taken note of the aforesaid representation and directed the competent authority to decide the representation by order dated 10.10.2017. The representation has not been decided till date.
No useful purpose will be served by keeping the petition pending. With consent of parties, the writ petition is being finally disposed off.
The matter is remitted back to the respondent No.2-District Magistrate, Farrukhabad.
A writ of mandamus is issued commanding the respondent No.2-District Magistrate, Farrukhabad to decide the claim of the petitioner for appointment to the post of Lekhpal pursuant to the recruitment held in the year 2015 within period of three months from the date of receipt of a certified copy of this order.
It is clarified that this Court has not gone into the veracity of the assertions of the writ petition nor has judged the claim of the petitioner on merits. It is for the competent authority to do so with an independent application of mind.
With the aforesaid direction the writ petition is finally disposed off.
