COMMON ORDER:
In these Writ Petitions, the petitioners allege that they purchased different plots of land in Sy.No. 128/1 of Yousufguda, Hydeerabad for valuable consideration. The said land was divided into plots by M/s. Saradhi Cooperative Housing Society Limited, Yousufguda, Hyderabad. The land covered by said survey number was declared surplus under the provisions of the Urban Land (Ceiling & Regulation) Act, 1976. The State Government issued G.O.Ms.No.49, Revenue (UC.II) Department, dated 18.01.2006 regularising the plots in favour of the petitioners. The petitioners raised one room and compound wall in their respective plots and they said that they submitted applications for building permission duly paying necessary fee. These Writ Petitions were filed when they were orally informed that their applications could not be considered as their plots are not covered under the approved layout and NOC from the Joint Collector was not submitted.
There is no evidence to show that the petitioners have submitted building applications except filing copy of receipt indicating payment of fee. The respondents also did not file counter affidavit.
In the circumstances, these Writ Petitions are disposed of directing the respondents to consider the applications of the petitioners for building permission as and when they file in accordance with law and pass appropriate orders thereon.
The Writ Petitions are accordingly disposed of. Miscellaneous petitions pending consideration if any shall stand closed. There shall be no order as to costs.
