Heard learned counsel for the applicant and the learned AGA for the State.
The applicant is complainant in Complaint Case under Section 138 of N. I. Act. He has approached this Court for expediting the hearing of the Complaint Case No.1370 of 2014, Munish Kumar Gautam Vs. Smt.Poonam Gautam and another, pending before the Additional Chief Judicial Magistrate, Court no.11, Agra. It has been alleged that the accused are not appearing in the complaint case and repeated non-bailable warrants are being issued against them but in vain.
In view of the facts and circumstances of the case, the Court below is directed to secure the presence of the accused by following the procedure under Cr.P.C and decide the aforesaid Complaint Case within a period of four months from the date of production of certified copy of this order.
Application is disposed of as above.
