Petitioner is the widow of one Ram Ashish, Resident of Village Parakamal, P.S. Khetasarai, District Jaunpur, who is said to have died in an accident on 28.4.2019. An application for payment of ex-gratia compensation under the Mukhyamantri Kisan Evam Sarvhit Beema Yojna has been moved by the petitioner and the grievance is that the claim has not been examined in accordance with the scheme. It is pointed out that Insurance Company in a routine manner has declined consideration of petitioner's application only because the panchnama has not been properly conducted. Submission is that once the accident is admitted the authorities were liable to consider petitioner's claim for payment of ex-gratia amount under the scheme.
Learned Standing Counsel states that a District Level Grievance Redressal Forum has been constituted under the scheme with the District Magistrate as its Chairman, who can examine all such issues.
In that view of the matter, we dispose off this writ petition with a direction upon second respondent to ensure that petitioner's claim is got examined, in accordance with the provisions contained in the scheme and necessary action as per it is taken, within a period of four months from the date of presentation of a certified copy of this order. Liberty stands reserved to the petitioner to annex all relevant materials in support of her claim, together with the certified copy of this order before second respondent.
