By means of this writ petition the petitioner has sought a direction directing the respondents to ensure payment of family pension to the petitioner and also direct the respondent-Bank to disburse the amount of pension regularly as and when it falls due.
This is a writ petition by the mother of Sachin Kumar who was a Constable in Bharat Tibbat Border Police Force. He went missing from 3.11.2014 and was presumed dead on account of drowning as the body was never recovered. The petitioner made rounds for family pension. From the writ petition it appears that pension payment order has been passed, yet it has not been paid so far.
The writ petition is disposed of with the direction to the respondents that in case the petitioner is entitled to family pension, for which it appears that she is entitled to and pension payment order has been passed, the same be duly paid to the petitioner without any further delay.
Subject to the aforesaid direction, the writ petition is disposed of.
Shri Sudeep Harkauli appears for the respondents no. 1 to 4 and Shri Sanjai Singh appears for the respondent no. 5.
