Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed seeking direction to the court below for early decision of Case No. 687 of 2017 (Old No. 1677 of 2016) (State Vs. Iqbal Farukhi and others) arising out of Case Crime No. 10 of 2009, under Sections- 143, 147, 148, 341, 427, 435, 504, 506 I.P.C. and Section 7 of Criminal Law Amendment Act and 3/4 Prevention of Public Damages Act, Police Station- Lohata, District- Varanasi.
It has been submitted by the learned counsel for the applicant that the application of the State filed under Section 321 Cr.P.C. for withdrawing the prosecution against the applicant is pending since 23.9.2016 before the court below and it is alleged that no orders have been passed thereon till date.
Without expressing any opinion on the merits of the case, this application is disposed of with a direction to the court below to pass the appropriate order in the aforesaid case in accordance with law, as expeditiously as possible, without granting any unnecessary or long adjournments to either of the parties, preferably within the period of three months from the date of production of a certified copy of this order, if there is no other legal impediment.
