Court No. - 19
Case :- WRIT - B No. - 2089 of 2019 Petitioner :- Smt. Munakka Devi Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Awadhesh Kumar Malviya Counsel for Respondent :- C.S.C.
Hon'ble Salil Kumar Rai,J.
It appears from the records that the grievance of the petitioner is that the map annexed with the order dated 2.5.2019 passed by the Consolidation Officer is not according to the situation and a road has been wrongly shown in Plot No.715 and the said plot is shown to have been divided in three parts. It is not clear as to whether the map annexed with the writ petition and with the order dated 2.5.2019 passed by the Consolidation Officer is in accordance with the entries made in CH Form 2-A and Statement of Principles published under Section 8-A of the U.P. Consolidation of Holdings Act, 1953. There is no statement regarding those facts in the writ petition.
Be that as it may, the petitioner has a remedy under the U.P. Consolidation of Holdings Act, 1953 to file objection before the Consolidation Officer and, if necessary, appeal and revision may be preferred before the Settlement Officer Consolidation and the Deputy Director of Consolidation.
For the aforesaid reason, it is not fit case for interference by this Court under Article 226 of the Constitution of India at this stage.
The writ petition is dismissed.
