It is submitted by learned APP, Mrs.Krina Calla on instructions from concerned Police Official present in Court that in the matter, charge is framed and evidence of complainant is also recorded and matter is kept for recording further evidence of complainant.
In view of the above, since this Court was not inclined to allow this application, learned counsel for the applicant seeks permission to withdraw this application. Permission is granted as prayed for. This application stands disposed of as withdrawn.
If trial is not over within six months, applicant is at Liberty to approach this Court and in that event, it will be decided on merits, in accordance with law and without being influenced by this order of withdrawal. Notice is discharged.
