Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition has been preferred seeking appointment on compassionate ground consequent to the death of the alleged husband of the petitioner while in service. The husband of the petitioner is stated to have died on 24 October 2017. The petitioner claims to be the legally wedded second wife of the deceased employee. It appears that the daughters of the erstwhile employee from his first wife have raised objections to the grant of appointment in favour of the petitioner. This is evident from the communication dated 6 June 2018 issued by the third respondent to the petitioner. Although pursuant to this communication, the petitioner had submitted a reply, the matter has not been decided finally till date.
Consequently without going into the merits or otherwise of the claim of the petitioner, this writ petition is disposed of with a direction to the third respondent to evaluate the claim of the petitioner for grant of compassionate appointment and dispose of the same in accordance with law. It is further provided that he shall proceed in the matter with due notice and opportunity of hearing to the daughters of the deceased employee.
