JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) Heard Mr.Shelat with Mr.Karia for the applicant and Mr.SB Vakil with Mr. Joshi for the respondent.
Considering the facts and circumstances, the time deserves to be extended.
However, Mr.Vakil, learned counsel appearing for the respondent submitted that the solvency certificate produced is unreliable and therefore, it cannot be treated as having accepted by this Court.
We find that the aforesaid apprehension is ill-founded because this Court in the order dated 25.11.2011 at paragraph 10(B) has already observed that the said aspect is to be examined by the lower court after intimating the other party. Hence, the following order-
Time as prayed for in para 13(B) is granted with the observation that acceptability or non-acceptability of the solvent security to the satisfaction of the trial court shall remain open in terms of direction at para 10(B) of the order dated 25.11.2011.
Application disposed of accordingly.
