Heard Sri Bhaskar Bhadra, learned Counsel for the applicants, learned A.G.A. for the State, Sri Deepak Singh Yadav, learned Counsel for opposite party no.2 and perused the record.
This application under Section 482 Cr.P.C. has been filed to quash the entire criminal proceedings of Case No.6000 of 2020 (State Vs. Javed & others) arising out of Case Crime No.70 of 2019 under Sections 498-A, 323 I.P.C. read with Section 3/4 of D.P. Act, Police Station- Mahila Thana, District Bareilly pending in the court of Chief Judicial Magistrate, Bareilly.
It has been submitted by learned Counsel for the applicant that it is a matrimonial dispute and parties have entered into compromise. The copy of compromise deed has been annexed as Annexure 4 to the affidavit filed in support of the application.
This Court vide order dated 10.2.2021 directed the parties to appear before the court below and file an application for verification of original compromised deed. As per report of Civil Judge (S.D.)/Fast Track Court, Bareilly dated 22.3.2021, the compromise between the parties was verified and parties were identified by their respective Counsel.
Learned Counsel appearing for opposite party no.2 does not disputed the aforesaid facts.
In view of the aforesaid fact, since the parties have amicably settled their dispute, no purpose would be served in keeping this application pending.
Accordingly, the application under Section 482 is allowed and entire criminal proceedings of Case No.6000 of 2020 (State Vs. Javed & others) arising out of Case Crime No.70 of 2019 under Sections 498-A, 323 I.P.C. read with Section 3/4 of D.P. Act, Police Station- Mahila Thana, District Bareilly is hereby quashed.
