The petitioner has preferred this public interest litigation for the following relief:
"(i) issue a writ, order or direction in the nature of mandamus commanding/directing the respondent direct the respondents to restore the Non Z.A. land situated at Village-Ajeetpur, Tehsil-Sadar, District-Rampur having Gata No.462/2, Khata No.023, area 0.051 hectare for shortage of Waste after removing the illegal construction and possession of respondent No.5.
(ii) issue a writ, order or direction in the nature of mandamus commanding/directing the respondents to take necessary steps for cancellation of illegal sale deed obtained by the respondent No.5.
(iii) issue any other writ order or direction which this Hon'ble court may deem fit and proper in the circumstances of the case.
(iv) award the cost of petition to the petitioner."
We have perused the material on the record and also heard learned counsel for the petitioner, we find that the public interest litigation does not raise any issue of the public importance.
Recently, the Supreme Court in the case of Tehseen Poonawalla v. Union of India and another, (2018) 6 SCC 72 has reiterated the earlier law in the P.I.L, only important matters which affect the public at large should be entertained.
In view of the above, we decline to entertain this public interest litigation and is, accordingly, dismissed.
Leaving it open to the petitioner to take recourse to such remedy, which is available to him under law.
