Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
Petitioner claims that he is entitled to be appointed as fair price shop licensee under the provisions of Government Order dated 26.03.2018. The petitioner has submitted an application to the respondent no. 3 in this regard. The said application has not been decided.
The sole prayer of learned counsel for the petitioner is that the application of the petitioner may be decided within a stipulated time frame.
Learned Standing Counsel has no serious objection to the prayer being granted.
No useful purpose will be served by keeping the writ petition pending. With consent the parties, the writ petition is being finally disposed of.
In view of the facts in the record, the respondent No.3 is directed to decide the application of the petitioner within a period of three months from the date of receipt of certified copy of this order along with a fresh copy of the application.
The respondent no.3 shall pass a reasoned and a speaking order in accordance with law.
The Court has not gone into the veracity of the assertions in the writ petition nor has agitated the claim of entitlement of the petitioner on merits. It is for the competent authority to do so after independent application of mind.
The writ petition is disposed of.
