~~~~~~~~~~~ The petitioner is the decree holder in O.S.No.139/2009 on the file of the Sub Court, Payyannur. The suit was filed by the petitioner for the recovery of advance amount paid to the respondents under an agreement for sale entered into between them. The suit was decreed in favour of the petitioner granting liberty to realise the decree amount of Rs.7 lakhs with 6% interest from the date of suit till realisation. Due to the delay in realisation of the decree amount, the petitioner has approached this Court praying for a direction to the Sub Court, Payyannur to take up E.P.39/2012 in O.S.139/2009 and pass necessary orders to enable him to realise the decree debt. 2. Heard the learned counsel for the petitioner. In the light of the order that is proposed to be passed by this Court, it is felt that notice to respondents is unnecessary.
3. Having regard to the above facts and circumstances of the case, this Original Petition is allowed and there will be a direction to the Sub Court, Payyannur to proceed with and pass O.P.(C) No.2319/2014 2 appropriate orders in Ext.P1 execution petition, as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a copy of this judgment.
