The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the orders dated 21.02.2019 passed in Writ Petition No.4442 of 2019 (Mukhtyar Hussain Vs. State of U.P. and others).
Pursuant to the order of this court, affidavit of compliance on behalf of opposite party has already been filed which is on record. It is stated in paragraph 6 of the affidavit that in compliance of the order of this Court, the S.D.M. Sadar Rampur by its order dated 10.01.2020 directed the Tehsildar, Tehsil Rampur to ensure demarcation of the plot in question, copy of the order dated 10.01.2019 is annexed as Annexure No.5 to the compliance affidavit.
At this stage, it is argued by learned counsel for the applicant that despite the aforesaid order, till the Tehsildar Tehsil Rampur has not complied the same.
In the facts and circumstances of the case, the present contempt application is disposed of directing the Tehsildar, Tehsil Sadar Rampur to pass appropriate orders in terms of the directions given in the order dated 10.01.2020 passed by S.D.M. Sadar, District Rampur most expeditiously and preferably within a period of two months from the date of production of a copy of this order before him.
In case, the said order is not complied with within stipulated period, the applicant has liberty to file fresh contempt application.
