The prayer in the present petition is to issue a direction to the licensing authority/District Magistrate, Bareilly to renew the firearm licence bearing Licence No.607/October-2000 of the petitioner firearm No. F.G. 10988 within stipulated period.
Submission is that after completion of the requisite formalities, the petitioner moved an application in the year 2015 itself but no steps whatsoever had been taken. Again a fresh application dated 15.09.2018 was moved by the petitioner for renewal of the licence which is pending.
On a pointed query made by the Court as to whether, the petitioner had deposited the firearm, it is contended that it has been deposited with the firearm vendor, however, no receipt of the said deposit had been brought on record.
In view of the fact that the renewal is pending consideration, without addressing the claim of the petitioner, the present petition is being disposed of with the direction to the District Magistrate, Bareilly to consider the renewal application after getting a receipt of the deposit of the firearm from the petitioner and considering that the petitioner is entitled to get renewal in accordance with law.
An expeditious decision shall be taken, preferably within a period of three months from the date of submission of certified copy of this order after completion of requisite formalities such as the reports regarding credential of the petitioner.
