List revised. No one is present for the revisionist. Learned A.G.A. is present for the State.
The above revision was filed in the year 1996 challenging the order dated 8.4.1996 passed by the Sessions Judge, Ghazipur whereby the application 89-B was dismissed. When the matter was filed none had appeared on 16.7.1996 to press the said revision. The Court had directed the matter to be listed in ordinary course. After 22 years, on 29.11.2018, when the matter was listed, none appeared on behalf of the revisionist to press the said revision even in the revised call, so the case was passed over on that date.
Again on 11.12.2018 none appeared on behalf of the revisionist and only learned A.G.A. was present on behalf of the State. The matter was again adjourned for the day.
Today again when the matter has come up in the revised call, none is present on behalf of the revisionist. Learned A.G.A. has pointed out that the permission to withdraw the prosecution case was rejected by the Sessions Judge by order dated 8.4.1996. More than 22 years have elapsed and by now the Session Trial must be over.
I have gone through the judgment and order dated 8.4.1996, passed by the Sessions Judge, Ghazipur rejecting the application 89-B of the revisionist for seeking withdrawal of the prosecution case, in case Crime No.44 of 1991, Sessions Trial No.100 of 1994.
I find no infirmity in the order passed by the court below. The revision is dismissed.
