This writ petition has been filed for issuing a writ of certiorari quashing the order dated 14.5.1999 passed by VIII A.C.M.M. Kanpur Nagar by which the petitioner's application filed under Section 5 of the Indian Limitation Act for condoning the delay in filing the restoration application to set aside the exparte order passed in the proceeding of under Section 21 (1) (b) of U.P. Act No. 13 of 1972 was dismissed holding that no proper explanation has been given to condone the delay.
This writ petition was filed in the year 1999 even the counter affidavit was not called for and the case was ordered to be listed in the regular cause list on the request of learned counsel for the petitioner. More than 10 years have expired by now decree must have been executed.
List has been revised. No one appears for the petitioner. I do not find any ground to interfere with the impugned order. The writ petition is dismissed.
