Ref.:-Order-sheet/Memo of application under Section 482 Cr.P.C.
Mr. Krishnaji Khare, learned counsel for the applicant, in view of averments made in paragraph nos. 1 to 4 of the affidavit accompanying Criminal Misc. Withdrawal Application No.5 of 2020, states that the present application under Section 482 Cr.P.C. be dismissed as withdrawn.
Mr. Ashish Pandey, learned counsel for the opposite parties (Narcotics Control Bureau, Lucknow) states that during the pendency of the present application under Section 482 Cr.P.C., the applicant has filed a petition before appropriate forum. He further submits that just after the opposite parties have filed their counter affidavit in the present application, under Section 482 Cr.P.C., learned counsel for the applicant has filed the Criminal Misc. Withdrawal Application No.5 of 2020, instead of filing the rejoinder affidavit to the same.
The present application under Section 482 Cr.P.C. is accordingly dismissed as withdrawn.
