Heard learned counsels for the parties and perused the record.
Petitioner, by means of the instant petition, is assailing the notice issued under Section 133 of Code of Criminal Procedure for removing encroachment made on public road.
Learned Standing Counsel submits that the writ petition against the notice to show cause is not maintainable.
Learned counsel for the petitioner submits that date fixed before the authority is on 30.07.2021. In the event of petitioner filing his objection on the date fixed, the same shall be considered by a reasoned and speaking order. Till passing of the order by competent authority, the structure shall not be demolished.
In the event the objection is not filed on the date fixed, the writ petition shall stand dismissed without further reference to the Court.
Petition disposed of.
