Heard Sri Arun Kumar Vishvakarma learned counsel for the applicant,Sri Prem Chandra Dwivedi, learned counsel for the informant and learned A.G.A. for the State and perused the statement of the victim recorded under Section 164 Cr.P.C.
Applicant-Mukesh seeks bail in Case Crime No.337 of 2018, under Sections 376F I.P.C. and 5/6 of The Protection of Children From Sexual Offcences Act, 2012, Police Station Fatehpur Sikri, District Agra.
Keeping in view the statement of the victim,aged about 8 years, in which she has stated the manner as to how she was sexually abused by the accused,I do not find any ground to consider the prayer for bail of the applicant. The prayer for bail is declined at this stage.
The application for bail is, hereby, rejected without expressing any opinion on the merit of the case.
However, the trial court is directed to expedite the trial of aforesaid case and conclude the same in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible, if there is no legal impediment.
