Heard Sri Ashutosh Upadhyay, learned counsel for the applicant and Sri Arun Kumar Singh, learned A.G.A. for the State.
This Bail Application (under Section 439 Cr.P.C.) has been moved for seeking bail in Case Crime No. 263 of 2017 under Sections 452, 307 and 506 I.P.C., P.S. Gunnaur, District Sambhal.
Learned counsel for the applicant stated that this is third bail application filed on behalf of applicant; four witnesses of fact have already been recorded by the trial court and they have not supported the case, hence, it is prayed that the accused may be released on bail; the accused applicant is in jail since 22.04.2017.
Learned A.G.A. has vehemently opposed the bail and stated that the second bail application of the applicant has already been rejected by this Court in Criminal Misc. Bail Application No. 39508 of 2017 on 14.11.2017 on merits.
Looking to the fact that the second bail application of the applicant has already been rejected by this Court on merits, this Court does not find good ground for enlarging the applicant, Mukesh on bail.
The bail application of the applicant, Mukesh is, accordingly, rejected.
We further direct the court below to make all endeavours to decide this case pending before it within two months if there is no legal impediment.
