Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the summoning order dated 04.04.2019 as well as the entire proceedings of Sessions Trial No. 203 of 2017 (State Vs. Anita and others), arising out of Case Crime No. 568 of 2014, under Sections- 302 and 120-B I.P.C., Police Station- Civil Lines, District- Budaun.
The applicant has been summoned under Section 319 Cr.P.C. After going through the order passed by the court below, no interference is called for. However, it is provided that if the applicant surrenders before the court below and applies for bail within a period of 30 days it shall be considered and decided in accordance with law.
Till then no coercive measures shall be taken against the applicant.
This application is disposed of.
