1. The applicant has taken out present application seeking below mentioned relief:
"5(B) Your Lordships may be further pleased to fix the date of final hearing of Special Civil Application No.328 of 2010 at an early date in the interest of justice.
5(C) Your Lordships in the alternative may direct the Opponent authorities to release the terminal benefits payable to the Applicant herein without prejudice to his rights and contentions in the present petition i.e. Special Civil Application No.328 of 2010 in the interest of justice."
2. The petition came to be admitted by order dated 26/03/2010. The said order reads thus:
"Rule.
To be heard with Special Civil Application No.178 of 2010 on 07.05.2010."
3. So far as the writ petition being Special Civil Application No.178 of 2010 is concerned, in the said petition below mentioned order has been passed on 11/03/2010:
"Rule returnable on 7th May 2010.
Mr. H.S Munshaw learned advocate waives service of rule on behalf of respondent No. 1 and 2. The parties shall complete the pleadings before the returnable date.
Heard.
Grant of interim relief as prayed for in this petition would amount to granting mandatory relief at this stage . Hence the interim relief is refused."
4. There is yet another petition being Special Civil Application No.3424 of 2010 which is also tagged along with the above mentioned two petitions in view of the order dated 08/04/2010 passed in Special Civil Application No.3424 of 2010.
5. Now, the applicant who is the petitioner in Special Civil Application No.328 of 2010, has taken out present application.
6. The office is directed to list Special Civil Application No.328 of 2010 for final hearing in view of the order dated 26/03/2010 passed in Special Civil Application No.328 of 2010.
7. With the aforesaid clarification, the Civil Application stands disposed of.
