Heard learned counsel for the petitioner.
This petition has been filed praying for a direction to the court of Civil Judge (Junior Division), Mathura to decide the 6C Application in O.S. No.384 of 2018 (Mukesh Singh vs. Bhola and others).
Perusal of the copy of the order-sheet annexed as Annexure-XII, shows that three dates have been fixed in this case. On the first date, i.e. 02.07.2018, none was present and the advocates were on strike. On 21.08.2018, when the case was called out, defendants were present but plaintiff was not present, therefore, the case was adjourned. On 20.10.2018, advocates were on strike. The next date was fixed for 07.12.2018. Nothing has been brought on record to show that what happened on 07.12.2018.
In view of the facts as afore-noted, I do not find any good reason to direct the court below to decide the aforesaid 6C Application within a time bound period.
In result, the petition fails and is hereby dismissed.
It is, however, expected that the concerned court below shall make endeavour to decide the aforesaid 6C Application, expeditiously.
