The applicant is husband and accused under Sections 498A, 304B, 323, 326 I.P.C. read with Section 3/4 of Dowry Prohibition Act.
It is contended on behalf of the applicant that it was a case of suicide and there is no evidence on the record to indicate that the applicant or his family has ever raised any demand of dowry. The applicant is in jail for the last four years.
Lastly, it was urged by learned counsel for the applicant that the minimum sentence is seven years under Section 304-B I.P.C. and the applicant has been incarcerated in jail for the last four years.
I have heard learned counsel for the applicant and the learned A.G.A..
Having due regard to the facts of the case, I do not find it a fit case to release the applicant on bail, however, it is directed that the trial be concluded expeditiously, preferably within eight months from the date of communication of this order.
Learned counsel for the applicant assures the Court that no unnecessary adjournment will be sought on behalf of the applicant.
The bail application is disposed of.
